Regulations on Quality Management of Water Conservancy Engineering

*Chapter General Provisions

*According to the State Council's "Outline for Quality Revitalization (1996-2010)" and relevant regulations, in order to strengthen the quality management of water conservancy projects and ensure project quality, this regulation is formulated.

Article 2: All units (including project legal persons (construction units), supervision, design, construction units, etc.) or individuals engaged in water conservancy engineering construction activities within the territory of the People's Republic of China must comply with these regulations.

Article 3: The water conservancy projects referred to in these regulations refer to various types of water conservancy projects, including flood control, flood control irrigation, hydropower generation, water supply, reclamation, etc. (including supporting and ancillary projects), constructed by national investment, central and local joint ventures, local investment, and other investment methods.

Article 4: The quality of water conservancy projects referred to in these regulations refers to the comprehensive requirements for the safety, applicability, economy, aesthetics, and other characteristics of the constructed water conservancy projects in the current relevant laws, regulations, technical standards, approved design documents, and engineering contracts of the country and the water conservancy industry.

Article 5: The Ministry of Water Resources is responsible for the quality management of water conservancy projects nationwide.

Each basin agency is entrusted by the Ministry of Water Resources to be responsible for the quality management of water conservancy projects under the jurisdiction of the basin agency, and to guide the quality management of local water administrative departments.
The water administrative departments of each province, autonomous region, and municipality directly under the central government are responsible for the quality management of water conservancy projects within their respective administrative regions.

Article 6: The quality of water conservancy projects shall implement a quality management system that combines the responsibility of the project legal person (construction unit), control by the supervision unit, guarantee by the construction unit, and government supervision.

The quality of water conservancy projects is fully responsible by the project legal person (construction unit). The supervision, construction, and design units are responsible for their respective work in accordance with the contract and relevant regulations. Quality supervision agencies fulfill the supervisory functions of government departments and do not replace the quality management work of project legal persons (construction units), supervisors, designers, and construction units. All parties involved in water conservancy engineering construction have the responsibility and right to report engineering quality issues to relevant departments and quality supervision agencies.

Article 7: The responsible persons of the legal person (construction unit), supervision, design, construction and other units of water conservancy projects shall take leadership responsibility for the quality work of their respective units. The project leaders of each unit at the construction site are directly responsible for the quality work of their unit at the construction site. The engineering and technical leaders of each unit are responsible for the technical aspects of quality work. The specific staff is the direct responsible person.

Article 8: All units of water conservancy engineering construction shall actively promote comprehensive quality management, adopt * quality management mode and management methods, promote * scientific technology and construction technology, rely on scientific and technological progress and strengthen management, strive to create high-quality projects, and continuously improve project quality.

Water administrative departments at all levels should reward units and individuals who have made contributions to improving engineering quality.

Article 9: Each unit of water conservancy engineering construction shall strengthen the education of quality control system, enhance the concept of quality legal system, regard improving the quality of workers as an important link to improve quality, strengthen the education of quality awareness and management knowledge of management personnel and employees, establish incentive mechanisms for quality management, and actively carry out mass quality management and rationalization suggestion activities.

Chapter 2 Engineering Quality Supervision and Management

Article 10: The government shall establish a system for supervising the quality of water conservancy projects.

Water conservancy projects are subject to quality supervision by quality supervision agencies authorized by the corresponding water administrative authorities in accordance with the principle of hierarchical management.

Article 11: Quality supervision institutions for water conservancy projects must be established in accordance with relevant regulations of the Ministry of Water Resources, and can only undertake quality supervision work for water conservancy projects after passing the qualification review of the water administrative department at or above the provincial level. Quality supervision agencies at all levels of water conservancy projects must establish and improve quality supervision mechanisms, supervision methods, and enhance the authority and effectiveness of quality supervision.

Quality supervision agencies at all levels of water conservancy projects should strengthen inspections on the implementation of relevant quality regulations and norms by the state and the Ministry of Water Resources, and resolutely investigate and punish behaviors such as non-compliance with laws, lax law enforcement, failure to investigate violations, and abuse of power.

Article 12: The water conservancy engineering quality supervision agency of the Ministry of Water Resources is responsible for the unified planning, management, and qualification review of basin agencies, provincial-level water conservancy engineering quality supervision agencies, and water conservancy engineering quality inspection units.

The water conservancy engineering quality supervision institutions established by each province, autonomous region, and municipality directly under the central government are responsible for the unified planning, management, and qualification review of water conservancy engineering quality supervision institutions and water conservancy engineering quality inspection units below the provincial level within their administrative regions.

Article 13: Water conservancy engineering quality supervision institutions are responsible for supervising the quality work of design, supervision, and construction units engaged in water conservancy engineering construction within the scope of their qualification levels; Responsible for inspecting and supervising the establishment and improvement of quality systems by construction, supervision, design, and construction units.

The water conservancy engineering quality supervision agency shall implement engineering quality supervision in accordance with relevant national and water conservancy industry construction regulations, technical standards, and design documents, and supervise and inspect behaviors that affect engineering quality on the construction site.

Article 14: The quality supervision of water conservancy projects shall be mainly carried out through spot checks, and legal and administrative means shall be used to handle the handling work after supervision and spot checks. When the project is completed and accepted, the quality supervision agency should verify the quality level of the project. Projects that have not been approved for quality or are deemed unqualified shall not be submitted for inspection by the construction unit, accepted by the engineering supervisory department, or put into use.

Article 15: As needed, quality supervision agencies may entrust qualified testing units certified by metrology to conduct sampling tests on relevant parts of water conservancy projects, as well as the building materials and engineering equipment used.

The data issued by the water conservancy engineering quality inspection agency recognized by the water conservancy engineering quality supervision agency of the Ministry of Water Resources is the final inspection of the national water conservancy system.

The testing data issued by the water conservancy engineering quality inspection institutions recognized by the provincial water conservancy engineering quality supervision agencies is the highest testing of the water conservancy system in this administrative region.

Chapter 3 Quality Management of Project Legal Person (Construction Unit)

Article 16: The project legal person (construction unit) shall be established in accordance with relevant regulations of the state and the Ministry of Water Resources, and actively accept the supervision and inspection of its quality system by the water conservancy engineering quality supervision agency.

Article 17: The project legal person (construction unit) shall, based on the scale and characteristics of the project, select survey and design, construction, and supervision units through qualification review and bidding in accordance with relevant regulations of the Ministry of Water Resources, and implement contract management. In the contract documents, there must be engineering quality clauses that clarify the quality standards of drawings, data, engineering, materials, equipment, etc., as well as the quality responsibilities of both parties to the contract.

Article 18: The project legal person (construction unit) shall strengthen engineering quality management, establish and improve the construction quality inspection system, and establish quality management institutions and systems based on the characteristics of the project.

Article 19: The project legal person (construction unit) shall handle the engineering quality supervision procedures with the water conservancy engineering quality supervision agency in accordance with regulations before the commencement of the project. During the construction process, it is necessary to actively accept the supervision and inspection of the project quality by the quality supervision agency.

Article 20: The project legal person (construction unit) shall organize the design and construction units to conduct design disclosure; During construction, the quality of the project should be inspected. After the completion of the project, relevant units should be organized in a timely manner for project quality acceptance and certification.

Chapter 4 Quality Management of Supervision Units

Article 21: The supervision unit must hold a qualification certificate for supervision units issued by the Ministry of Water Resources, and undertake the supervision tasks of corresponding water conservancy projects in accordance with the approved supervision scope. The supervision unit must accept the supervision and inspection of its supervision qualification quality inspection system and quality supervision work by the water conservancy engineering quality supervision institution.

Article 22: The supervision unit must strictly comply with national laws, water conservancy industry regulations, and technical standards, and strictly fulfill the supervision contract.

Article 23: The supervisory unit shall dispatch corresponding supervisory agencies to the construction site of water conservancy projects according to the supervisory tasks it undertakes, and the personnel allocation must meet the project requirements. Supervising engineers must hold a supervising engineer position certificate issued by the Ministry of Water Resources before taking up their posts, and general supervising personnel must undergo pre job training before taking up their posts.

Article 24: The supervisory unit shall participate in the bidding work in accordance with the supervision contract, and issue construction drawings from the perspective of ensuring the quality of the project and fully fulfilling the construction contract; Review the construction organization design and technical measures of the construction unit; Guide and supervise the implementation of quality standards and requirements in the contract; Participate in engineering quality inspections, investigation and handling of engineering quality accidents, and engineering acceptance work.

Chapter 5 Quality Management of Design Units

Article 25: Design units must undertake survey and design tasks according to their qualification level and business scope, and should actively accept supervision and inspection of their qualification level and quality system by water conservancy engineering quality supervision institutions.

Article 26: Design units must establish and improve a design quality assurance system, strengthen quality control in the design process, establish a sound system for reviewing and approving design documents, and carry out technical disclosure of design documents.

Article 27: Design documents must meet the following basic requirements:
(1) The design documents shall comply with the requirements of relevant national and water conservancy industry engineering construction regulations, engineering survey and design technical specifications, standards, and contracts.
(2) The basic information of the design basis should be complete, accurate, and reliable, the design argumentation should be sufficient, and the calculation results should be reliable.
(3) The depth of the design documents should meet the relevant requirements of the design stage, and the design quality must meet the engineering quality, safety needs, and comply with the requirements of the design specifications.

Article 28: The design unit shall provide design documents and construction drawings in a timely manner in accordance with the contract provisions. During the construction process, it shall keep abreast of the construction site situation, optimize the design, and solve relevant design problems. For large and medium-sized projects, the design unit shall establish a design representative office or dispatch design representatives at the construction site in accordance with the contract provisions.

Article 29: Design units shall provide evaluation opinions on whether the construction quality meets the design requirements during stage acceptance, unit project acceptance, and completion acceptance in accordance with relevant regulations of the Ministry of Water Resources.

Chapter 6 Quality Management of Construction Units

Article 30: Construction units must undertake construction tasks according to their qualification level and business scope, and accept supervision and inspection of their qualifications and quality assurance system by water conservancy engineering quality supervision institutions.

Article 31: Construction units must carry out construction in accordance with relevant national and water conservancy industry regulations, technical specifications, technical standards, as well as the requirements of design documents and construction contracts, and be responsible for the quality of their construction projects.

Article 32: Construction units shall not subcontract the main works of the water conservancy construction projects they undertake. For the subcontracting of projects, the subcontracting unit must have the corresponding qualification level and be responsible to the general contracting unit for the construction quality of its subcontracted projects. The general contracting unit is responsible to the project legal person (construction unit) for all project quality. Engineering subcontracting must be approved by the project legal person (construction unit).

Article 33: The construction unit shall implement comprehensive quality management, establish and improve a quality assurance system, formulate job quality standards, quality responsibilities, and assessment methods, and implement a quality responsibility system. During the construction process, it is necessary to strengthen quality inspection work, conscientiously implement the "three inspection system", and effectively control the entire process of project quality.

Article 34: In the event of a quality accident in a project, the construction unit must report to the supervision unit, the project legal person (construction unit), and relevant departments in accordance with relevant regulations, protect the site, accept the investigation of the engineering quality accident, and handle the accident seriously.

Article 35: The quality of completed projects must comply with the current engineering standards and design document requirements of the state and the water conservancy industry, and complete technical files, test results, and relevant information should be submitted to the project legal person (construction unit).

Chapter 7 Quality Management and Engineering Warranty of Building Materials and Equipment Procurement

Article 36: The quality of building materials and engineering equipment shall be the responsibility of the purchasing unit. All building materials and engineering equipment entering the construction site shall be inspected in accordance with relevant regulations. Products that fail inspection shall not be used in engineering.

Article 37: The purchasing units of building materials and engineering equipment have the right to independently purchase in accordance with the contract provisions, and other units or individuals shall not interfere.

Article 38: Building materials or engineering equipment shall meet the following requirements:

(1) There is a product quality inspection certificate of qualification;
(2) Product name, manufacturer name, and address indicated in Chinese;
(3) The product packaging and trademark style comply with relevant national regulations and standard requirements;
(4) Engineering equipment should have detailed product manuals, and electrical equipment should also be accompanied by circuit diagrams;
(5) Products that implement production licenses or quality certifications should have corresponding licenses or certification certificates.

Article 39: The warranty period for water conservancy projects shall generally not be less than one year from the completion date stated in the project handover certificate. The warranty period for projects with special requirements is specified in the contract.

If there are permanent defects in the engineering quality, the period of responsibility shall not be limited by the above warranty period.

Article 40: If there are any quality problems with water conservancy projects during the prescribed warranty period, the original construction unit shall generally bear the warranty, and the required expenses shall be borne by the responsible party.

Chapter 8 Penalty Provisions

Article 41: In case of major engineering quality accidents in water conservancy projects, they shall be dealt with seriously. Notify and criticize the responsible units, lower their qualification levels, or confiscate their qualification certificates; Administrative disciplinary action shall be imposed on the responsible person, and if the offense constitutes a crime, it shall be transferred to the judicial authorities for handling.

Article 42: If a water conservancy engineering quality accident causes personal injury or property damage, the responsible unit shall provide economic compensation to the damaged party in accordance with relevant regulations.

Article 43: If the project legal person (construction unit) engages in any of the following behaviors, its competent department shall issue a notice of criticism or other disciplinary measures.

(1) Failure to select survey, design, construction, and supervision units with corresponding qualification levels according to regulations;
(2) Failure to follow the prescribed procedures for engineering quality supervision;
(3) Carrying out the next stage of construction without timely acceptance of completed projects as required, and delivering the project for use without completion or stage acceptance;
(4) Failure to report major engineering quality accidents to relevant departments in a timely manner in accordance with relevant regulations.

Article 44: If survey, design, construction, or supervision units engage in any of the following behaviors, they shall be criticized, downgraded, or even have their qualification certificates confiscated according to the severity of the circumstances. Economic sanctions shall be handled in accordance with the contract provisions. If they violate the law, they shall be dealt with in accordance with relevant national laws:
(1) Undertaking tasks without a license or beyond the qualification level;
(2) Not accepting supervision from water conservancy engineering quality supervision agencies;
(3) Design documents that do not meet the requirements of Article 27 of these regulations;
(4) The completed and delivered project does not meet the requirements of Article 35 of these regulations;
(5) Failure to implement quality warranty as required;
(6) Using untested or unqualified building materials and engineering equipment, or producing shoddy, cutting corners, or forging records during construction;
(7) Failure to report major engineering quality accidents to relevant departments in a timely manner in accordance with relevant regulations;
(8) The water conservancy engineering quality supervision agency has determined that the engineering quality level is unqualified or the project needs to be reinforced or demolished.
Article 45: If a testing unit forges inspection data or forges inspection conclusions, it shall be criticized, its qualification level shall be lowered, and its qualification certificate shall be confiscated according to the severity of the circumstances. Those who cause serious consequences due to forgery shall be dealt with in accordance with relevant national regulations.

Article 46: For quality supervision institutions that fail to conscientiously fulfill their responsibilities for water conservancy engineering quality supervision, the corresponding water administrative department or its higher-level water conservancy engineering quality supervision institution shall issue a notice of criticism, replace the person in charge, revoke authorization, and carry out organizational restructuring.

If the staff engaged in engineering quality supervision fail to enforce the law strictly, violate the law without investigation, abuse their power, or accept bribes, they shall be subject to administrative sanctions by their unit or superior competent department. If a crime is constituted, criminal responsibility shall be pursued in accordance with the law.

Chapter 9 Supplementary Provisions

Article 47: The Ministry of Water Resources is responsible for interpreting these regulations.

Article 48: These regulations shall come into effect from the date of their promulgation.
